This is the agreement between you and Bailey Martin for the Pochi app. Using Pochi means you accept it. If you don't, don't use the app.
Pochi is not medical advice
Pochi is a fitness app meant for general information and motivation. It is not a medical device, and nothing it tells you is medical, nutritional or health advice. That covers calorie and macro targets, body-fat estimates, the Health Score, and everything the AI features say.
Talk to a doctor before you start or change how you eat or train, particularly if you're pregnant, injured, or have any medical condition. Don't ignore or delay real advice because of something Pochi said. If you feel unwell or something hurts, stop and get help.
The food scanner guesses a meal from a photo using AI. It gets things wrong. Check anything that actually matters.
Training is your responsibility. Use sensible weights and decent technique.
Your account
You need an account to sync between devices. Look after your login details, because you're responsible for whatever happens under your account. Email pochi.app@hotmail.com if you think someone else has got in.
You have to be at least 13. One account each.
Your data
It stays yours. The Privacy Policy covers what's stored and why. Delete it all from Profile → Account whenever you like.
You keep everything you enter. We only take the permission needed to actually run the app for you: storing it, syncing it, and showing the parts you've chosen to share with friends you accepted.
Premium
Some things need a subscription. Right now that's the AI food scanner, the AI trainer and program responses, Coach's Take, and some cosmetics.
Prices show in the app in your currency before you buy. Apple or Google charge you when you confirm. Subscriptions renew on their own unless you cancel at least 24 hours before the period ends, and you cancel in your App Store or Play Store settings, not in Pochi.
Deleting your Pochi account does not cancel a subscription. Refunds are Apple's and Google's to give, under their own policies, not ours.
If prices go up, existing subscribers get told first, and we may keep you on what you're already paying.
Gifts (Pochi Tickets)
A gift is a one-off purchase, not a subscription. Nothing renews for anybody. A code adds Premium time when it's claimed, and stacks on top of whatever Premium you already have.
Codes aren't worth money, can't be swapped for money, and can't be refunded once claimed. Don't post one publicly, because whoever redeems it first keeps it.
Using it fairly
Don't break the law with Pochi. Don't try to get Premium without paying for it. Don't attack the service or hammer the AI features with scripts. Don't upload anything unlawful, abusive, or that isn't yours to upload. Don't harass people or pretend to be someone else.
The AI features are rate-limited per account.
Friends and the bug tracker
The bug tracker is shared, so anything you write or attach there can be seen by other signed-in users. Friends see the handle and stats listed in the Privacy Policy.
If something posted by another user is offensive or abusive, email pochi.app@hotmail.com and it'll be looked at. Content that breaks these terms gets removed, and accounts that keep doing it get suspended.
Availability
We'll try to keep Pochi up, but it won't always be. Things change, features get removed, and the AI parts depend on other companies' services that go down sometimes.
There are backups, but don't keep anything in Pochi you can't afford to lose.
Ending it
Stop whenever you want, and delete your account from Settings. We can suspend or close an account that breaks these terms.
Liability
As far as the law allows, Pochi comes as-is with no warranties, and we're not liable for indirect or consequential loss, or for any injury or health outcome from using it. Our total liability caps at whatever you paid us in the 12 months before the claim.
None of that removes rights you have by law that can't be removed, including the consumer guarantees under the Australian Consumer Law.
Changes
If these terms change the date at the top changes, and anything material gets flagged in the app. Carrying on using Pochi means you accept the update.
Governing law
These terms are governed by the laws of Queensland, Australia.
